This Telehealth Informed Consent ("Consent") is provided by Ivologist Weight Loss Center, LLC, doing business as Ivologist ("Ivologist," "we," "us"). By clicking "I Agree" or otherwise indicating acceptance, you acknowledge that you have read and understood this Consent and voluntarily consent to receive healthcare services through telehealth from licensed clinicians who are employed by or contracted with Ivologist ("Providers"). If you do not agree, do not access or use Ivologist telehealth services.

1. Purpose of This Consent

This Consent explains how healthcare services can be delivered to you through virtual technologies and your rights and responsibilities when receiving telemedicine care. Ivologist offers telehealth-enabled services that may include: metabolic health and weight-management consultations; medical weight-loss treatment plans (e.g., GLP-1 and other medications, when appropriate); hormone optimization (HRT, TRT, perimenopause and menopause support); wellness and vitality care; peptide therapy consultations; mobile IV therapy assessments and oversight; laboratory testing orders and interpretation; and ongoing follow-up, monitoring, and lifestyle support. Your Provider will determine whether telehealth is clinically appropriate for your condition.

2. What Telehealth Is

"Telehealth" (or "telemedicine") refers to the delivery of healthcare services when you and your Provider are not in the same physical location. Telehealth may include secure video consultations; audio-only consultations where permitted; secure messaging or chat; remote review of labs, images, and medical history; and transmission of medical records or health data. Telehealth may be used for evaluation, diagnosis, treatment planning, follow-up, and patient education.

3. Licensure and Your Location

Ivologist is based in Texas and provides telehealth services to patients in multiple states. You understand and agree that: (a) your care will be provided by a Provider licensed in the state where you are physically located at the time of your visit; (b) your Provider must comply with the telemedicine laws and medical-board rules of that state, which may require identity verification, an initial video (rather than audio-only) evaluation, or an in-person examination for certain treatments; (c) you must accurately tell us the state you are located in at the time of each visit; and (d) telehealth services are available only in states where our Providers are licensed. Texas patients: telehealth services comply with Texas Medical Board telemedicine requirements.

4. Benefits of Telehealth

Telehealth may offer convenient access to Providers specializing in metabolic, hormonal, and wellness care; reduced travel and faster appointment availability; integrated care coordination including labs and medication management; and access from the comfort and privacy of your home. However, no results, outcomes, or improvements are guaranteed.

5. Risks and Limitations of Telehealth

Telehealth has inherent risks, including but not limited to: technical failures (internet outages, poor connections, equipment issues); delays in care due to incomplete information; limitations of a virtual examination; the possible need for in-person care or diagnostics; data privacy risks inherent to electronic transmission; and medication side effects or adverse reactions requiring follow-up or emergency care. You may be advised to seek in-person services if telehealth is insufficient for your condition, and you have the right to decline telehealth and seek in-person care at any time.

6. Emergencies

Ivologist cannot provide emergency medical care. If you are experiencing an emergency — including chest pain, difficulty breathing, severe allergic reaction, sudden weakness, or thoughts of self-harm — call 911 immediately or go to the nearest emergency room. Telehealth is not appropriate for urgent or life-threatening situations.

7. Laboratory Testing, IV Therapy, and Prescriptions

Your Provider may order or recommend laboratory tests, diagnostic screenings, mobile IV therapy, or medications including GLP-1s, hormones, peptides, or wellness prescriptions. You understand that: lab services and IV therapy may be provided by independent third parties; medication prescribing is never guaranteed and always depends on the Provider’s clinical judgment; controlled substances will not be prescribed via Ivologist telehealth; you may request that prescriptions be sent to a pharmacy of your choice; some therapies may require updated labs, physical exams, or additional follow-up; and you may be advised to undergo in-person evaluation where required by the medical laws of your state or by clinical standards. Compounded medications, where prescribed, are not FDA-approved; your Provider will discuss risks and alternatives with you.

8. Patients Aged 13 to 17

Patients aged 13 to 17 may receive care only where clinically appropriate and permitted by the laws of the patient’s state, and only with the written consent of a parent or legal guardian. The parent or guardian must create and manage the patient’s account, must be available during telehealth visits as directed by the Provider, and consents on the minor’s behalf by accepting this Consent. Certain treatments are not available to minors where restricted by law. We do not provide services to children under 13.

9. Privacy, Security, and Communications

Ivologist protects your information using administrative, technical, and physical safeguards, and your health information is protected as described in our Notice of Privacy Practices and Privacy Policy (https://ivologist.com/privacy-policy). However, no method of electronic communication is 100% secure; email, SMS, or phone communications may not be encrypted and may contain limited health-related information only with your consent; and you are responsible for the security of your own devices and accounts.

10. Your Responsibilities

You agree to: provide complete and accurate medical information, including medications, allergies, and medical history; update your Provider about any changes in your condition or side effects; accurately report your physical location at the time of each visit; participate from a private and safe location; follow instructions regarding diagnostic tests, treatments, and follow-up care; and use the platform appropriately and not for emergencies. Failure to provide accurate information may affect your Provider’s ability to evaluate and treat you safely.

11. Financial Responsibility

You understand and agree that: you are responsible for all fees associated with telehealth visits, labs, medications, and services unless stated otherwise; Ivologist may not participate in insurance networks; if your plan does not reimburse Ivologist’s services, you may be responsible for the full cost; and prices for treatment plans, labs, medications, and IV therapy will be disclosed before purchase. Refunds are governed by the Refund Policy in our Terms of Service.

12. Complaints

If you have a concern about your care, please contact us at info@ivologist.com or 210-436-8822. You also have the right to file a complaint with the medical board of the state where you received care. Texas patients may contact the Texas Medical Board: 1-800-201-9353, www.tmb.state.tx.us, or Texas Medical Board, Attention: Investigations, MC-263, P.O. Box 2018, Austin, TX 78768-2018.

13. Right to Withdraw Consent

You may withdraw your consent to telehealth at any time by notifying Ivologist in writing at info@ivologist.com. Withdrawal will not affect care already provided but may affect your ability to continue receiving services through Ivologist. Withdrawal of consent will not result in any penalty or loss of benefits to which you are otherwise entitled.

14. Acknowledgment and Consent

By clicking "I Agree" or otherwise electronically signing, you acknowledge that: you have read this Telehealth Informed Consent in full and had the opportunity to ask questions; you understand the benefits, risks, limitations, and alternatives to telehealth, including in-person care; you voluntarily consent to receive healthcare services via telehealth from the Providers; you understand that you may withdraw this consent at any time; and, if you are a parent or legal guardian accepting on behalf of a patient aged 13 to 17, you consent to the minor’s treatment as described in Section 8.
